GENERAL CREDITOR REPRESENTATION/CLAIMS SUBMISSION
Austria Legal provides advice and counsel to secured and unsecured creditors during various stages of bankruptcy proceedings. Creditors' rights are controlled by the Bankruptcy Code, the Federal Rules of Bankruptcy Procedure, local rules, applicable case law, orders of the bankruptcy court, and various other provisions. Austria Legal guides its creditor clients through the complex bankruptcy process.
BANKRUPTCY LITIGATION/
PREFERENCE ADVERSARY PROCEEDING REPRESENTATION
A large portion of Austria Legal's practice is devoted to defending vendors, suppliers, manufacturers, contractors and subcontractors, consulting firms, food and beverage companies, apparel companies, oil and gas companies, healthcare companies, advertising firms, insurance companies, and transportation companies (among many others) in adversary proceedings filed in the United States Bankruptcy Court. Most of these cases include claims for recovery of alleged preferential transfers under Section 547 of the Bankruptcy Code. Austria Legal also assists with the pre-litigation resolution of preference demands.

BANKRUPTCY MOTIONS AND OBJECTIONS PRACTICE
REPRESENTATION
Austria Legal regularly represents creditors and other interested parties in conjunction with motions for relief from automatic stay, motions for allowance and payment of administrative expense claims (including claims pursuant to section 503(b)(9) of the Bankruptcy Code), motions to assume or reject executory contracts and unexpired leases, and various other motions filed in the bankruptcy court. The firm also files responses to omnibus objections to claims and assists creditors in obtaining full payment of cure amounts owed as part of the executory contract/unexpired lease assumption process.
